A bench of Chief Justice Manindra Mohan Srivastava and Justice G Arul Murugan reiterated Concern over such announcements Being made without certification. Parasaran informed the court that KVN Productions had already received approval to release the film in 22 other countries. He further argued that the CBFC Chairman cannot go back on his earlier decision of granting certification after informing the producers that the film would receive a U/A rating subject to certain modifications.

It is common to announce the release date earlier

“In 22 countries, we have got approval. It is not a practice to wait for the certificate to announce the money. If you look at Bollywood, they have already announced Dhurandhar 2,” he said, ”The decision was taken unanimously, and even if a member later takes a different view, the majority decision should be valid. Currently, minority opinion is controlling the process,” reported live law india.

During the arguments, Parasaran also told the court that the film’s official streaming partner Prime Video had threatened to sue the makers if there was no clarity on the December 31 release date.

The high court also questioned the producers as to why they did not give enough time to the Central Board of Film Certification (CBFC) to file a counter affidavit in the case. The bench further asked why the producers did not object to the board’s January 6 letter seeking review of the film’s certification by the review committee.

The producers claimed that they were kept in the dark about the complaint made by a member of the investigating committee. He said the complaint letter was also submitted to the court in a sealed cover. The producers also said that they called it an ‘absurd request’ from the board.

CBFC wants producers to add deleted scenes

He told the court that after complying with all the excerpts recommended by the screening committee, the CBFC had asked him to reproduce the deleted scenes so that the revised committee could look at them again and decide on certification.

KVN Productions argued, “For what purpose should I reintroduce the excised portions into the film? The whole exercise is futile.” He said that they have invested around Rs 500 crore in this project.

However, the court reiterated that allowing single judges to pass orders without giving the opposite party an opportunity to file a counter affidavit could set a dangerous precedent. Earlier, the single bench of Justice PT Asha CBFC directed to issue U/A 16+ certificate, which was later canceled by the Division Bench.

Madras High Court has reserved its decision If.

The film was originally scheduled to release on January 9. Earlier last week, KVN Productions had approached the Supreme Court against the order of the division bench of Madras High Court directing the CBFC to put the certification on hold till the completion of the hearing.
