Madras High Court flags ‘dangerous trend’ after Censor Board delays Jannayakan

The Madras High Court cleared Jana Nayagan with a U/A 16+ certificate and slammed the CBFC for eleventh-hour objections that stalled the film’s release. The film starring Vijay is now aiming to release in Pongal 2026.

Madras High Court has given U/A certificate to Vijay. Jan Naygan And also slammed the Central Board of Film Certification (CBFC) for making eleventh-hour changes in the certification process. The intervention came after objections were raised by an examination committee member against the final decision of the panel.

The judgment emphasized that objections raised after recommendations have been made cannot derail the certification process. Madras HC gave its final verdict on Friday Jan NayganWith 29 cuts and U/A 16+ certificate.

The film’s release was postponed after the CBFC did not issue certification on time after a board member raised objections to certain parts of the film. This resulted in a legal dispute, forcing the producers to approach the Madras HC, even though advance bookings had already begun across India and abroad.

Justice PT Asha, while pronouncing the order, said, “After examining the materials, it is quite clear that the complaint of the complainant appears to be an afterthought.” The court also said that considering such complaints would lead to a “dangerous trend”.

He said, “Furthermore, such a retort by a screening committee member who recommended the film after watching and assimilating it would give rise to a dangerous trend of members retracting their recommendation and the sanctity placed on the decision of the CBFC’s screening committee would be destroyed.”

The ruling further noted that the Board’s action was without jurisdiction and once the amendments recommended by the scrutiny committee were completed, certificate for the film should have automatically followed.

It further states: “The exercise of the power by the Chairperson is without jurisdiction, as the Chairperson’s power to send for review came to an end when she informed on behalf of the Committee that the UA certificate would be given subject to rip-off.”

The judgment emphasized that the structured certification process cannot be disrupted by individual disagreements following formal recommendations, warning that allowing such exceptions could undermine the credibility of the system.

The second hearing is scheduled for 3:30 pm on January 9.

The decision came on a day when the court directed the CBFC to issue a U/A 16+ certificate to Vijay. Jan NayganWhich was stuck amidst controversy. The film was originally scheduled to be released on January 9, 2026, but was postponed.

According to the producers, the delay caused huge losses, including approximately 2 lakh tickets unsold in advance booking and a monetary loss of Rs 50 crore.

After Friday’s order, the makers are now expected to announce the revised release date soon. Industry sources indicate that Jan Naygan It may hit the theaters in a few days or align with the Pongal festival on January 14.
