The clip shows Esmeralda Upton approaching four Indian-origin women and hurling racial slurs at them. She then proceeds to physically assault three of the women.
In the video, he can be heard shouting, “I hate you Indians. Go back to India… we don’t want you here.”
She continued making racist comments even after Plano police arrived, Fox News reports.
In the video, Upton can be heard saying, “Don’t mess with me. I’ll ruin your curry.”
According to Fox News, Esmeralda Upton, 59, was sentenced to two years of community supervised probation and 40 days in the Collin County Jail nearly two years after the incident.
He pleaded guilty to multiple charges, including assault and making terrorist threats in furtherance of a hate crime.
According to M9 News, under the plea agreement, Esmeralda Upton will serve her sentence on weekends beginning July 19, with the warning that failing to do so could result in her being in prison consecutively.
One of the victims, Anamika Chatterji, read a statement before Upton’s sentencing, describing the trauma the attack caused to her and her family.
“My American-born children look like Indians. Because of your hatred and attacks, I now live in constant fear for them,” Chatterjee said, NBC News reported.
“That is the worst effect of what you did to me – the constant worry and anxiety. I am shocked that someone from a minority background like you – which you bragged about during the incident – can behave in this way without any shame,” he said.
The reference to the minority background was made because Upton described herself as Mexican-American during her speech.
The 40-day jail sentence, and that too on weekend shifts, came two years later. A civil suit against Upton by the victims is still pending.
