Court restrains T-Series from using the word ‘Aashiqui’ in film titles

The Delhi High Court has issued an interim injunction to prevent T-Series from using the word ‘Aashiqui’ in the title of the film. The court ruled in favour of Special Films, which has trademark rights over the mark ‘Aashiqui’.

The Delhi High Court has issued an interim order restraining T-Series from using the title ‘Tu Hi Aashiqui’ or ‘Tu Hi Aashiqui Hai’ for any upcoming film. The decision is in favour of Special Films, the co-producer of the original ‘Aashiqui’ series.

The court acknowledged the title ‘Aashiqui’ as an important brand associated with successful films released in 1990 and 2013. Justice Sanjeev Narula said that the use of these titles by T-Series may cause confusion among the public and dilute the ‘Aashiqui’ brand. Special Films had registered the trademarks for ‘Aashiqui’ in 2013 and ‘Aashiqui Ke Liye’ in 2014.

The court highlighted that the two companies had previously collaborated on ‘Aashiqui’ films, and neither could exploit the franchise without the other’s consent. The decision comes after T-Series announced a film with a similar title, which Special Films argued could mislead the public.

The court also said that the name ‘Aashiqui’ has become an integral part of a recognised film series, and protection of such titles is important to maintain their exclusivity. Special Films Managing Director Vishesh Bhatt expressed satisfaction over the verdict, saying it upholds their commitment to preserve the legacy of their franchise. The court’s decision emphasises the importance of protecting the titles of famous series to avoid misleading consumers and diluting brand identity.
