But after discussing with civic leaders and the Attorney General of California and Delaware, Openai decided to modify its curriculum.

Now, the profit will still be restructured to raise capital, but the non-profit firm will maintain control. “OpenIE was established as a non-profit, today is a non-profit that oversees the profit and controls them, and moving ahead will be a non-profit that will not change,” Altman wrote.

The lawsuit still stands, says Musk

Even after Altman’s efforts to compromise, Musk’s legal team is not confident. Musk’s lawyer, Mark Toboff said, “The announcement obscured important details about the alleged ‘non-profit control’ system.” The lawsuit, which wants a jury test, is still going to ahead in March 2026.

In his trial, Musk also brings the sudden dismissal (and sharp restoration) of Altman as the CEO of OpenAI in 2023. He alleged that Microsoft’s influence was behind the board’s reshuffle, which “replaces technical experts with the board members due to lack of scientific and technical understanding.”
